British Wool Terms & Conditions

1. Who We Are
1.1 Wool Growers (Great Britain) Limited trading as British Wool operates the British Wool website shop.britishwool.org.uk (Site). Wool Growers (Great Britain) Limited is a company registered in England and Wales under company number 00628994 and with its registered office at Wool House, Canal Road, Sidings Close, Bradford, BD2 1AZ. If you wish to contact British Wool you can write to us at Sidings Close, Canal Road, Bradford, West Yorkshire, BD2 1AZ.
1.2 British Wool (through the Site) provides a marketplace for sellers to make products available for you to purchase. British Wool is therefore neither a buyer nor a seller of the Products, but merely facilities the sales between you and a seller. The contract for the sale of the products is between you and the relevant seller and will include these Terms (Contract).
1.3 British Wool will not be liable for the Contract or any claim or dispute arising out of or in connection with it.

2. Other Terms That May Apply To You
2.1 These terms and conditions (together with our Privacy & Cookies Policy and the Terms of Website Use (together Terms) tells you information about us and the basis on which you may make use of the Site to browse the Site and/or buy any of the products listed on the Site (Products).
2.2 In addition to reading these Terms, to which you have agreed by using this Site, you should also refer to the terms and conditions of each individual seller (Seller Terms) before making any order. The Seller Terms (if applicable) will be available on each seller’s Product page and Our Brands page. Not every seller will have Seller Terms. These Terms will take priority over any Seller Terms.
2.3 Please note, any reference to “Terms” within this document includes these Terms and any additional Seller Terms.

3. Updating These Terms
3.1 These Terms may be updated from time to time as set out in clause 4. Every time you wish to order Products, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 30th April 2021.

4. British Wool’s Right To Vary These Terms
4.1 In respect of existing and new orders. British Wool may change these Terms at any time to reflect changes in relevant laws and regulatory requirements. Any amendment to these Terms under this clause shall be effective for all existing and new orders submitted following the publication of the amendment on the Site. If British Wool do need to change these Terms for this reason, it will notify you and you may then contact us to end the Contract before the changes take effect and receive a refund for any Product(s) you have paid for but not received.
4.2 In respect of new orders only. British Wool reserves the right to change these Terms at any time. Any amendment to these Terms under this clause shall be effective exclusively for all new orders submitted following the publication of the amendment on the Site. Please check the Terms posted on the Site before submitting your order.

5. Use Of This Site
5.1 Your use of the Site is governed by Website Use Terms. Please take the time to read this document as it includes important terms which apply to you.
5.2 You acknowledge and accept that your failure to use the Site in accordance with these Terms and any document referred to in these Terms may result in your access to the Site being blocked.
5.3 You may only purchase Products from the Site if you are at least 18 years old.

6. How We Use Your Personal Information
6.1 Your personal information will be used in accordance with the Privacy & Cookies Policy. Please take the time to read this document, as it includes important terms which apply to you.

7. Your Contract With The Seller
7.1 A Contract will form between you and the seller when you purchase any Products and will include these Terms.
7.2 These Terms therefore apply to the Contract between you and the seller and references in the Terms to “we”, “us” and “our” shall relate to the seller NOT British Wool.
7.3 Please read these Terms carefully. Before placing an order you should make sure that you understand and are comfortable with these Terms and the seller you are dealing with as British Wool cannot give any guarantee or warranty as to the Products supplied by the seller.
7.4 You should print a copy of these Terms or save them to your computer for future reference.
7.5 These Terms, and any Contract between you and the seller, are only in the English language.

8. Information About Sellers
8.1 Information on each seller including the company name, company number, registered office and, where applicable, the trading address and VAT number are available on the Meet our Brands page on the Site.

9. Our Products
9.1 The images of the Products on the Site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours accurately reflect the colour of the Products. Your Products may vary slightly from those images.
9.2 Although we have made every effort to be as accurate as possible, all sizes, weights, capacities, dimensions and measurements indicated on the Site have a 5% disparity.
9.3 All Products shown on the Site are subject to availability. We will inform you by e-mail as soon as possible if the Product you have ordered is not available and we will process a refund of the full amount to your payment card as soon as practicably possible.

10. Our Contract With You
10.1 After you place an order, you will receive an e-mail from us acknowledging that we have received your order (Order Acknowledgement). However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place when we email you to confirm the Product has been dispatched at which point a Contract will come into existence between you and us. Without affecting your rights to return the Product(s) set out in these Terms, you can cancel your order for a Product at no cost to you at any time before we dispatch the Product(s) to you.
10.2 If we are unable to supply you with a Product (for example because that Product is not in stock, no longer available or because of an error in the price on the Site as referred to in clause 12.5), we will inform you of this by e-mail and we will process a refund of the full amount to your payment method as soon as practicably possible.

11. Non-Acceptance Of An Order
11.1 We may not accept your order because of one of the following:
11.1.1 the Product you ordered being unavailable from stock;
11.1.2 our inability to obtain authorisation for your payment; or
11.1.3 the identification of a pricing or Product description error.

12. Our Rights To Make Changes
12.1 We may change our Products to reflect changes in relevant laws and regulatory requirements and/or to implement technical adjustments and improvements (for example to address any safety issues). These changes will not affect your use of our Products.

13. Delivery
13.1 During the order process the vendor will let you know when you can expect to receive the Product(s).
13.2 Your order will be fulfilled by the delivery date confirmed to you in the Order Acknowledgement, unless there is an event outside our control (see clause 24).
13.3 Delivery will be completed when the vendor deliver the Products to the address you gave them.
13.4 The Products will be your responsibility from the completion of delivery.
13.5 You own the Products once we have received payment in full, including all applicable delivery charges.

14. International Delivery
14.1 We only deliver the Products to mainland UK.

15. Price Of Products And Delivery Charges
15.1 The prices of the Products will be as quoted on the Site. We take all reasonable care to ensure that the prices of Products are correct at the time when the relevant information was entered onto the system. However, if we discover an error in the price of the Product(s) you ordered, please see clause 14.5 for what happens in this event.
15.2 Prices for our Products may change from time to time, but changes will not affect any order which we have confirmed to you via email.
15.3 The price of a Product includes VAT (where relevant) at the applicable current rate chargeable in the UK for the time being.
15.4 The price of a Product does not include delivery charges (unless otherwise stated). Our delivery charges are as quoted on the Site. To check current delivery charges, please refer to the relevant Meet our Brands page on the Site for the Product you are ordering.
15.5 The Site contains a large number of Products. It is always possible that, despite our reasonable efforts, some of the Products on the Site may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that:
15.5.1 where the Product’s correct price is less than the price stated on the Site, we will issue you with a refund for the difference between the price you paid and the actual price of the Product. However, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price; and
15.5.2 if the Product’s correct price is higher than the price stated on the Site, we will contact you by email as soon as possible to inform you of this error. We will then give you the option of cancelling your order or cancelling your order and continuing to purchase the Product at the correct price. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process within 7 days, we will treat the order as cancelled and notify you in writing.

16. How To Pay
16.1 You can only pay for Products using any major debit or credit card through British Wool’s online payment processing system. We accept the following cards: Discover, Visa/Visa Debit, Mastercard, JCB, and American Express (AMEX). The currency displayed will always show in GBP (£).
16.2 Payment for the Products and all applicable delivery charges is in advance. After the payment is approved, we will dispatch your Products using the shipping method you selected on purchase.
16.3 Please note that your payment made through the Site will be received by us (the seller) not British Wool. These arrangements shall not affect any rights that you may have against us under these Terms.

17. Manufacturer Guarantees
17.1 Some of the Products we sell to you come with a manufacturer’s guarantee. For details of the applicable terms and conditions, please refer to the manufacturer’s guarantee provided with the Products.
17.2 If you are a consumer, a manufacturer’s guarantee is in addition to your legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office.

18. Your Consumer Right Of Return And Refund
Consumer’s 14 day right to change their mind (Consumer Contracts Regulations 2013)
18.1 If you are a consumer then for most goods bought online you have a legal right to change your mind within 14 days and receive a refund.
18.2 You have 14 calendar days after the day you (or someone you nominate) receives the Products to change your mind.
18.3 Your right as a consumer to change your mind does not apply in respect of any Products you order that are made to your specifications or are clearly personalised.
If there is a problem with the Product
18.4 If you have any questions or complaints about the Product, please contact us by using the email address supplied to you in the order confirmation or on the Meet our Brands section of the Site.
18.5 We are under a legal duty to supply the Products so that they conform with the relevant Contract. As a consumer, you have legal rights in relation to Products that are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.
18.6 If you wish to exercise your legal rights to reject defective Products you must post them back to us. We will pay the costs of postage.
Ending the Contract because of something we have done or are going to do
18.7 Ending the Contract because of something we have done or are going to do. If you are ending a Contract for a reason set out at 18.7.1 to 18.7.4 below the Contract will end immediately and we will refund you in full for any Products which have not been provided and you may also be entitled to compensation. The reasons are:
18.7.1 we have told you about an upcoming change to the Products or these Terms which you do not agree to;
18.7.2 we have told you about an error in the price or description of the Products you have ordered and you do not wish to proceed;
18.7.3 there is a risk that supply of the Products may be significantly delayed because of events outside our control; or
18.7.4 you have a legal right to end the Contract because of something we have done wrong.

19. How to end the Contract with us?
19.1 To end the Contract with us, please let us know:
19.1.1 By email. To the seller at the relevant email address found in the Our Brands page Please provide your name, home address, details of the order and, where available, your phone number and email address;
19.1.2 Notification. By submitting a notification through your customer account.

20. Returning Products After Ending The Contract
20.1 If you end the Contract for any reason after the Products have been dispatched to you or you have received them, you must return them to us. You must post them back to the address supplied to you in the order confirmation or on the Meet our Brands section of the Site.
20.2 If you are a consumer exercising your right to change your mind you, must send off the Products within 14 days of telling us you wish to end the Contract.
20.3 We will pay the costs of return:
20.3.1 if the Products are faulty or misdescribed; or
20.3.2 if you are ending the Contract because we have told you of an upcoming change to the Products or these Terms, an error in pricing or description, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong.
20.4 In all other circumstances (including where you are a consumer exercising your 14 day right to change your mind) you must pay the costs of return.

21. Refund
21.1 We will refund you the price you paid for the Products, excluding the delivery cost, by the method you used for payment. However, we may make deductions from the price, as described below.
21.2 We may make a deduction from refunds if you are a consumer exercising your 14 day right to change your mind. If you are exercising your right to change your mind we may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the Product, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the Product and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
21.3 The maximum refund for delivery costs will be the costs of delivery by the least expensive delivery method we offer.
21.4 If you are consumer exercising your right to change your mind then your refund will be made within 14 days from the day on which we receive the Products back from you or, if earlier, the day on which you provide us with evidence that you have sent the Products back to us. For information about how to return a Product to us, see clause 20.
21.5 The money will be returned within 7-10 workings day.

22. Our Liability
22.1 We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this Contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
22.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for:
22.2.1 death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors;
22.2.2 for fraud or fraudulent misrepresentation;
22.2.3 for breach of your legal rights in relation to the Products including the right to receive products which are:
a. as described and match information we provided to you and any sample or model seen or examined by you;
b. of satisfactory quality;
c. fit for any particular purpose made known to us;
d. supplied with reasonable skill and care and, where installed by us, correctly installed; and
e. for defective Products under the Consumer Protection Act 1987.
22.3 We are not liable for business losses. We only supply the Products for domestic and private use. If you use the Products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

23. Discount Codes
23.1 Discount Codes are available to use on Products purchased from the Site.
23.1.1 Discount codes may be available to use on Products purchased from the Site.
23.1.2 Discount codes are not valid for use in conjunction with any other promotion or deal (including but not limited to Site-wide discount events or Product deals discounted by British Wool), unless otherwise specified.
23.1.3 Discount codes are applied to the value of the order and maybe subject to additional terms and conditions available on the Site.
23.1.4 Discount codes are only valid on Products while stocks last and may be withdrawn at any time.
23.1.5 Discount codes will expire on the date and time specified upon being issued.
23.1.6 Only one discount code can be used per order.
23.1.7 Any refunds will take into account the discount applied to the item/s ordered.

24. Events Outside Of Our Control
24.1 We are not responsible for delays outside our control. If our supply of the Product(s) is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. If we are unable to meet the estimated delivery date because of an event outside our control, we may contact you with a revised estimated delivery date. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the Contract and receive a refund for any Products you have paid for but not received.

25. How To Contact The Seller
25.1 You can contact us by using the email address and/or postal address supplied to you in the Order Acknowledgement or on the Meet our Brands section of the Site.

26. How We May Contact You
26.1 If we have to contact you or give you notice in writing, we will do so by e-mail or by pre-paid post to the address you provide to them in your order.

27. Other Important Terms
27.1 When we use the words “in writing” or “written” in these Terms, this includes e-mail.
27.2 You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing.
27.3 The Contract is between you and us. No other person shall have any rights to enforce any of its terms, except British Wool.
27.4 Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.
27.5 If we fail to insist that you perform any of your obligations under these Terms, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
27.6 If you are a consumer, please note that these Terms are governed by English law. This means a Contract for the purchase of Products through the Site and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are a resident of Scotland, you may also bring proceedings in Scotland.
27.7 We will not file a copy of the Contract between us.
